The Indiana House of Representatives has advanced legislation authored by State Representative Ben Smaltz, aiming to allow the expungement of records related to Indiana's red flag law under certain conditions.
House Bill 1137, introduced by Rep. Smaltz, mandates courts to expunge records if an individual is deemed not dangerous. The bill also includes provisions for sealing law enforcement and court records concerning firearm seizures, making them inaccessible unless a court orders otherwise.
"This legislation is imperative for safeguarding Second Amendment rights and recognizing that there is always work to be done while also highlighting the importance of procedural justice," stated Smaltz.
The proposed bill seeks to amend current Indiana statutes by establishing clear guidelines for petitioning courts for expungement. It also sets evidence-based standards for assessing whether an individual continues to pose a risk.
