The Indiana House of Representatives has advanced legislation proposed by State Representative Chris Jeter aimed at bolstering public safety through increased funding for deputy prosecutors. The bill, known as House Bill 1006, seeks to enhance the retainment and competitiveness of prosecuting attorneys' wages by establishing the Public Prosecution Fund.
Jeter explained that this fund would allow the Indiana Prosecuting Attorneys Council to reimburse eligible counties up to 50% for expenses related to prosecution and public defender services. "House Bill 1006 would make a once-in-a-generation investment toward the state’s criminal justice system," he stated. "The bill would support law and order by reimbursing qualified and participating counties up to 50% of the salary and benefits packages of deputy prosecutors to ensure Indiana’s courts and criminal justice system protects public safety and all Hoosiers."
This initiative aims to address salary concerns for deputy prosecutors, potentially reducing turnover rates in a state where nearly all 92 counties have fewer lawyers per capita than the national average, according to data from the Indiana Supreme Court.
In addition, Jeter's proposal includes the creation of a Special Prosecutor Unit within the Indiana Prosecuting Attorneys Council (IPAC). This unit is intended to increase the number of qualified special prosecutors who can assist in cases involving conflicts of interest or those requiring additional legal resources. Currently, special prosecutor candidates must have eight years of experience as either a prosecutor or deputy prosecutor.
The bill also proposes establishing a prosecutor review board tasked with examining instances where prosecutors refuse to prosecute certain criminal laws. Should a prosecutor be deemed noncompliant by this board, funding from IPAC could be withheld.
"Law and order have long been the basis of Indiana’s society, and we believe funding should be based on upholding Hoosier values and these principles," Jeter emphasized.
