Abbott proposes bill targeting squatter issues in Indiana

State Representative David Abbott has introduced a new bill aimed at strengthening the rights of property owners in Indiana against unauthorized occupants. House Bill 1189 seeks to establish legal procedures to facilitate the removal of squatters from residential properties.

"House Bill 1189 would streamline the process for Hoosiers to reclaim their property from those who are illegally occupying it while ensuring that law enforcement has clear authority to act swiftly," Abbott stated. The proposed legislation is intended as a "common-sense protection" for property owners.

The bill introduces an affidavit process, allowing property owners to request the immediate removal of squatters. It also sets strict civil penalties for individuals who knowingly make false statements about occupancy.

Under this legislation, law enforcement agencies would be mandated to serve an immediate notice to vacate and restore possession of the property to its rightful owner. Additionally, entering a dwelling without permission and causing intentional damage would constitute a Level 6 felony. Abbott clarified that this measure is not designed as an alternative legal procedure between landlords and tenants.
