Governor signs bill allowing juries to know about seat belt use in crashes

Gov. Eric Holcomb ceremonially signed into law legislation authored by State Rep. Jim Pressel (R-Rolling Prairie) on Thursday, allowing the disclosure of seat belt usage in vehicle accidents during civil trials.

Previously, Indiana law did not permit a jury in a civil trial to know if individuals involved in an accident were wearing their seat belts. With research indicating that seat belts significantly reduce the risk of death and injury in car crashes, Pressel said he authored House Enrolled Act 1090 to consider seat belt usage when determining damages.

"Seat belts do a lot to protect drivers and passengers from serious injury," Pressel stated. "So, when someone is injured in an accident, it is important to consider all of the factors that may contribute to injuries, such as not wearing seat belts."

Under the new law, judges may allow juries to review evidence on whether a passenger or driver aged at least 15 years old was wearing a seat belt during an accident when deciding damages in civil lawsuits. Pressel emphasized that damage determinations are crucial for recovery following a car accident.
