Rep. McNamara's bill advances to protect first responder confidentiality

State Representative Wendy McNamara's proposed legislation aimed at safeguarding the confidentiality of first responders during debriefings after traumatic incidents has advanced past the committee stage. The bill, known as House Bill 1118, is now set for consideration by the full House of Representatives.

The bill stipulates that first responders who undergo critical incident stress management (CISM) debriefing will not be obligated to disclose any details from these sessions in civil, criminal, or administrative proceedings. CISM debriefings are designed to help first responders process traumatic experiences encountered in the line of duty and mitigate potential long-term mental health issues.

"Our first responders face a variety of intense and dangerous situations," McNamara stated. "These debriefings can be vital to the mental health of Hoosier law enforcement officers, firefighters, emergency medical providers and others, and they should not be required to discuss these private conversations."

The legislation also proposes that neither first responders receiving CISM services nor their employers would be liable for damages in court based on their communication unless there is evidence of wanton, willful, or intentional misconduct. This measure aims to encourage the use of CISM services without fear of mandatory disclosure.

Statistics from the Ruderman Family Foundation indicate that first responders experience PTSD and depression at rates five times higher than those in the civilian population. To support these individuals, Indiana hosts over 40 CISM teams comprised of trained peer volunteers who provide immediate care or counseling following emergencies.
