Gov. Mike Braun has signed into law a bill aimed at strengthening privacy protections for consumers who use genetic testing services. The legislation, authored by State Representative Kyle Pierce (R-Anderson), requires companies such as 23andMe and LifeDNA to obtain consent before using or sharing an individual’s genetic data. It also prohibits these providers from sharing identifying information with insurers and employers.
The new law comes after 23andMe filed for Chapter 11 bankruptcy in March and sought to sell its assets, including large amounts of customer genetic data. This development raised concerns about the privacy of sensitive information, leading customers to consider deleting their data and requesting the destruction of biological samples.
“Hoosiers should never have to worry about their most personal information being used against them,” Pierce said. “This law sets clear safeguards for genetic data and ensures consumers remain in control of their privacy. Protecting data and sensitive information is critical when building trust in these technologies.”
Under the law, providers must disclose specific details to consumers who submit biological material for testing, including how the material is collected, used, and protected. The legislation also bars companies from sharing genetic data with insurers, data brokers, or employers. Any shared third-party data cannot include identifying details such as names or addresses so that it cannot be used against consumers in ways like raising insurance rates or denying coverage.
House Enrolled Act 1521 received bipartisan support during the 2025 legislative session.
Pierce represents House District 36, which covers part of Madison County.
